Their official statement against the company stated that the marketers had made unsubstantiated claims, among which the fact that the products had been independently researched and tested by reporters from the media outlet networks. Also, there was no visual or written indicator to point to the paid advertisement content of the articles, which left readers believing that they were reading actual news. Additionally, the company that designed the websites and ran the ads was promising a free trial of the advertised products, even though, in actuality, clients would go on to be charged for subsequent orders of the product.

The world of affiliate management has been recently plagued by several such scandals, which point to a faulty understanding of the field’s best practices. On the one hand, affiliate marketers need to be weary of clients that sell products which haven’t been properly tested and approved by the authorities that need to approve them. On the other, clients also need to exercise proper caution when approving such marketing campaigns. In an effort to generate new sales leads, certain marketing agencies will resort to back-handed strategies, such as the above-illustrated one, in which the prestige and credibility of a trusted news source is used for misleading purposes.

According to FTC representatives, the $2 million earned as a result of the settlement will go toward refunding the costs of consumers who got duped by the Clickbooth campaign.
